I did (apparently) agree to this when I ticked the T&C box, but I wonder if I can claim the fee back from BA/Chase visa?

You can say 4X points per dollar is “not a sign-up bonus”, but since it’s only available during the first year, it’s more like a variable bonus. Now if the BA Visa gave 4X points per dollar spent EVERY year, that would be a whole different ball game.
